What is Probate?   It’s simply the term used to describe the legal process of transferring a decedent's estate to the rightful heirs.

The probate process involves collecting and identifying the deceased person's property,  paying any debts and taxes, and identifying the proper heirs and distributing the estate property to them. While the court oversees this process, in most cases the work is done by the executor or the administrator of the decedent's estate with the help of an attorney.

In many cases a full probate is not required.  A summary probate or a transfer of property without probate may be possible when the assets of the deceased person were valued at less than $100,000, or if all assets passed from a husband to wife or wife to husband by a will.
